TERMS AND CONDITIONS

Each order is considered as an explicit acceptance of the general terms and conditions set by the buyer.

 

Article 1: General provisions

These General Terms and Conditions ("Terms") apply to any order placed by a visitor to our site ("Customer"). By placing an order via the Floorissimo webshop, the Customer expressly accepts these Terms, excluding all other terms and conditions. Additional terms from the Customer are only valid if accepted in writing by Floorissimo.

Article 2: Price

​

All prices are in EURO, inclusive of VAT and applicable taxes. The price for the smallest available size is displayed; additional sizes will show corresponding prices. Delivery, reservation, or administrative costs, if applicable, will be stated separately.

 

The quotation of price relates exclusively to the articles as it is described verbatim. The accompanying photos are intended to be decorative/informative and may contain elements that are not included in the price

 

 

Article 3: Offer

Floorissimo strives for accuracy but is not liable for incomplete or outdated information. Offers are valid while supplies last and can be modified or withdrawn at any time.

 

Availability

If an item is simultaneously selected in-store, we reserve the right to serve the in-store customer first. Customers will be notified if an item becomes unavailable, and refunds will be processed promptly.

 

Color

We aim to depict products accurately, but slight color variations may occur due to different screen settings.

 

 

Article 4: Online purchases

The ordering process via Floorissimo is as follows:

 

  1. Select a product and add it to the cart.

  2. Press 'Order' and provide login details.

  3. If new, create an account with delivery details.

  4. Choose a payment method and confirm the order.

  5. An order confirmation will be sent via email.

The Customer has the choice between the following payment methods:

 

  •  by Credit card

  •  by Bancontact

  •  by Mobile Pay

  •  by Payconic

  •  by Paypal

  •  by Ideal

 

Floorissimo does not charge any costs for the use of the aforementioned payment methods.

 

Floorissimo is entitled to refuse an order as a result of a serious shortcoming of the Customer with regard to orders in which the Customer is involved and whether there is a suspicion of fraud.

 

 

Article 5: Delivery and execution of the agreement

Your order will be shipped on average within 5-7 working days after receipt of your payment unless otherwise reported. However, we are not responsible for delays from our suppliers. In the event of an abnormal delay due to force majeure or unforeseen circumstances, we will inform the Customer immediately, including information about the updated delivery period.

We are not liable for any damage, loss, or other issues during shipment. Customers are responsible for providing accurate delivery information; incorrect addresses may incur additional costs. If a Customer requests a different delivery method, any extra costs will be charged to them.

​

Risks of loss or damage to goods transfer to the Customer at the time of delivery. If the Customer fails to comply with contractual obligations, risks transfer when delivery should have occurred.

​

Products are delivered in the Benelux and other European countries, and rates can be found under delivery and shipping.

 

 

Article 6: Retention of title

​

The delivered items remain the exclusive property of Floorissimo until the moment of full payment by the Client.

 

The Client undertakes, if necessary, to inform third parties of the retention of title of Floorissimo, e.g. to any person who may attach the items that have not yet been fully paid for.

Article 7: Warranty


Customers are entitled to legal rights under Belgian law for defective products. For questions or complaints, contact us via email or phone.

Article 8: Penalties for non-payment

​

In case of non-payment, Floorissimo reserves the right to charge 10% interest per annum on the unpaid amount, plus a fixed fee of 10% of the amount owed (minimum €25). Floorissimo is entitled to refuse an order if there is a serious shortcoming by the Customer or suspicion of fraud.

Article 9: Privacy

​

Floorissimo complies with the Belgian law of December 8, 1992, on data protection. Details on data usage can be found in our privacy policy.

Article 10: Use of cookies

​

Our site uses cookies as outlined in our cookie policy. By using our site, you consent to our use of cookies.

Article 11: Damage to validity - failure to act

If any provision of these Terms is held to be invalid, illegal or void, the validity, legality and applicability of the other provisions shall not be affected in any way.

 

Failure by Floorissimo at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereunder, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.

Article 12: Amendment of conditions

These Terms may be amended. Customers will be notified of significant changes. Continued use after changes indicates acceptance.

Article 13: Evidence

The Customer accepts that electronic communications and backups may serve as evidence.

Article 14: Intellectual property

You can always consult the website 'Floorissimo'; Floorissimo.com. External commercial use of this website and its data is only permitted with written permission. Nothing on this webpage may be copied, stored and/or distributed for commercial purposes without the written permission of Floorissimo. 'Floorissimo' is not responsible for external websites and social media to which she may be linked.

Article 15: Applicable law - Disputes

​

We strive for customer satisfaction. Complaints can be directed to us via email. Belgian law governs these Terms, and disputes will be handled by the courts of Dendermonde, unless otherwise stipulated.
